1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your use of the websites, applications, memberships, and related services offered by The Calm Resolve Method (“we,” “us,” or “our”), including Calm Resolve (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not access or use the Services.
2. What Calm Resolve Is and Is Not
Calm Resolve provides AI-assisted communication reflection and decision-support tools for current or past interactions, including dating, family, friends, work, strangers, and other everyday situations. It may provide an observable communication read, a recommended next move, a short line when appropriate, reasoning, and a time-bounded plan.
The Services are not therapy, mental-health treatment, crisis care, emergency services, legal advice, medical advice, financial advice, a safety plan, or a determination of another person’s thoughts, motives, or intentions. The Services do not guarantee a response, relationship outcome, safety outcome, or any other result. You remain responsible for your choices and for evaluating whether any guidance is suitable for your situation.
3. Eligibility and Account Responsibilities
You must be at least 18 years old to use the Services. You agree to provide accurate information, keep your account credentials confidential, and promptly notify us of unauthorized access. You are responsible for activity that occurs under your account.
You must not provide content that is unlawful, infringing, threatening, abusive, or otherwise prohibited; upload confidential information you are not authorized to disclose; attempt to access another user’s account; interfere with the Services; scrape, reverse engineer, or circumvent access controls; or use the Services to stalk, harass, threaten, manipulate, or harm another person.
4. Safety Boundaries
Do not use Calm Resolve for threats, fear, coercive control, stalking, surveillance, sexual pressure, immediate danger, repeated unwanted contact, self-harm concerns, or other unsafe situations. In those circumstances, seek support from emergency services, local resources, a qualified professional, or another appropriate source of help. Calm Resolve may limit or halt routine communication guidance when the entered context indicates a safety concern.
5. Founding Membership, Billing, and Cancellation
Calm Resolve Founding Membership is offered at $9 per month while your membership remains active. Membership includes up to 10 full AI Next-Move Plans per billing month and access to available member features as described at the time of purchase. The membership automatically renews each billing period unless you cancel before the next renewal date.
You authorize our payment processor to charge your selected payment method for recurring membership fees and applicable taxes. You may cancel through the account or billing path provided at purchase. Cancellation takes effect at the end of the current paid billing period unless otherwise required by law. Payments are nonrefundable except where required by law or expressly stated at checkout.
We may change prices or membership features in the future. If we make a material change to a recurring fee, we will provide notice as required by applicable law before the change takes effect.
6. Your Content and Feedback
You retain any rights you have in content you submit to the Services. You grant us a limited, non-exclusive, worldwide license to process that content solely to operate, secure, maintain, and improve the Services, consistent with our Privacy Policy. You represent that you have the right to submit your content and that doing so does not violate another person’s rights or applicable law.
If you provide feedback, suggestions, or ideas, you grant us permission to use them without restriction or compensation to you.
7. Intellectual Property
The Services, including their software, content, visual identity, methods, text, and design, are owned by or licensed to The Calm Resolve Method and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-transferable, revocable right to use the Services for your own personal, non-commercial use.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE AVAILABILITY.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE CALM RESOLVE METHOD AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, USE, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to defend, indemnify, and hold harmless The Calm Resolve Method and its owners, officers, employees, contractors, and service providers from claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Services, your content, or your violation of these Terms or applicable law.
11. Suspension and Termination
We may suspend or terminate your access to the Services if we reasonably believe you have violated these Terms, created risk or legal exposure for us or others, or misused the Services. You may stop using the Services at any time and may request deletion as described in our Data Deletion page.
12. Governing Law and Disputes
These Terms will be governed by the laws of Alabama, without regard to its conflict-of-law rules. Courts located in Alabama will have exclusive jurisdiction over disputes arising out of or related to these Terms, unless applicable law requires otherwise.
13. Changes and Contact
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. If you continue to use the Services after an update becomes effective, you accept the updated Terms to the extent permitted by law.
